Northeast Natural Energy Sues Morgantown over Drilling Ban

Northeast Natural Energy filed suit last week in Monongalia County Circuit Court after the City Council of Morgantown passed an ordinance that bans horizontal fracking within a mile of the city.  Northeast was granted permits by WVDEP to drill and frack two Marcellus wells within 3000 feet of the Morgantown Utility Board public water intake on the Mon River.   The wells are within the radius of property included in the ordinance.

Chief Judge Russell Clawges did not grant a temporary restraining order against the ordinance which was sought by Northeast.
