<p><strong>Public Meetings &#8212; Understanding Unitization of Interests or “Forced Pooling&#8221;</strong></p>
<p>What is pooling? Who benefits? What does it mean to be “forced”?<br />
What was in House Bill 2688 (Providing for the unitization of interests in drilling units in connection with all horizontal oil or gas wells)? What are the concerns with Forced Pooling? What were the concerns with House Bill 2688? What and when will new legislation be proposed?</p>
<p><strong>Presenters:</strong> Joshua Fershee, Associate Dean for Faculty Research and Development and Professor of Law, WVU College of Law; Delegate Lynwood “Woody” Ireland (R-Ritchie, 07); *Delegate Pat McGeehan (R-Hancock, 01); and **Senator Mike Romano (D-Harrison, 12). <p><strong>July 13: Not Your Grandparent&#8217;s Oil &amp; Gas Industry, Meeting Two</strong></p>
<p><a title="http://www.wowktv.com/story/29327495/fracking-companies-asking-for-surface-and-mineral-rights-in-west-virginia-eastern-kentucky" href="http://www.wowktv.com/story/29327495/fracking-companies-asking-for-surface-and-mineral-rights-in-west-virginia-eastern-kentucky" target="_blank">About 200 folks showed up</a> for a recent<a title="http://wvpublic.org/post/rogersville-shale-next-formation-be-fracked" href="http://wvpublic.org/post/rogersville-shale-next-formation-be-fracked" target="_blank"> meeting</a> hosted by our friends at the Ohio Valley Environmental Coalition (OVEC) titled &#8220;<a title="http://ohvec.org/temp/Rogersville-Wayne-Cabell-Forum.pdf" href="http://ohvec.org/temp/Rogersville-Wayne-Cabell-Forum.pdf" target="_blank">Not Your Grandparent&#8217;s Oil &amp; Gas Industry.</a>&#8221;</p>
<p>At that meeting, we heard from lawyers, including WV-SORO&#8217;s Dave McMahon and activists like Bill Hughes who have been dealing with <a title="http://appalachianchronicle.com/2015/06/29/fracking-poses-threats-to-public-health-say-experts/" href="http://appalachianchronicle.com/2015/06/29/fracking-poses-threats-to-public-health-say-experts/" target="_blank">shale-fracking</a> issues in other parts of the state. Now OVEC is having a second meeting where folks can share, in a moderated discussion, stories of what is already happening in Wayne and surrounding counties.</p>

			<content:encoded><![CDATA[<p></p><div><span style="font-size: x-small;">On June 2<sup>nd</sup> the public meeting entitled &#8220;Public Meeting on the Adverse Impacts of Marcellus Natural Gas Activities: Where Are We, Where Are We Going&#8221; was held at the Skyview Elementary School, near the Marcellus well site at the Morgantown Industrial Park. One of the significant themes of this meeting was the public health risks to the public water supply, to the regional air quality and from the very large increase in truck traffic. <a title="Watersheds Compact=">The minutes of that meeting</a> have been posted to the UMRA web site. </span></div>

<div><span style="font-size: x-small;"> </span><span style="font-size: x-small;"><span style="font-size: x-small;">More recently, the health secretary in Pennsylvania has recommended a plan to study these public health risks. Health Secretary Eli Avila told Governor Corbett&#8217;s Marcellus Shale Advisory Commission that creating a health effects registry is the timeliest and most important step the Department of Health could take given the level of Marcellus drilling underway, and that his agency is not aware of anything like it in other drilling states. This <a title="Pennsylvania Health Secretary recommends health effects database" href="http://www.post-gazette.com/pg/11169/1154672-503.stm" target="_blank">story is in the Pittsburgh Post-Gazette</a>. </span></span></div>
<div><span style="font-size: x-small;"> </span></div>
<div><span style="font-size: x-small;"><span style="font-size: x-small;">Collecting information on drilling-related health complaints, investigating them, centralizing the information in one database and then comparing illnesses in drilling communities with non-drilling communities could help refute or verify claims that drilling has an impact on public health, he said. The aggregation of data and information also would allow the Department of Health to make its findings public, in contrast to the privacy that surrounds its investigation into individual health complaints and the findings that may result, <a title="Health Effects Database Recommended" href="http://www.theintelligencer.net/page/content.detail/id/556253/Pa--Wants-Gas-Drilling-Illness-Database.html?nav=5233 " target="_blank">according to the Wheeling Intelligencer</a>.</span></span></div>

			<content:encoded><![CDATA[<p></p><p><a href="/wp-content/uploads/2011/02/capitol-dome.jpeg"><img class="alignleft size-thumbnail wp-image-968" title="capitol dome" src="/wp-content/uploads/2011/02/capitol-dome-147x150.jpg" alt="" width="147" height="150" /></a>Approximately 100 citizens appeared at a public hearing for the benefit of legislators at the Capitol in Charleston,WV to state their views about Marcellus shale gas industry.   A significant majority of the speakers stated that the shale gas industry is having negative impacts on the environment and public health and that there is not adequate regulation.   At least one speaker called for a moratorium.  The hearing was scheduled to take place for an hour and a half and each speaker was allowed only one minute.  The legislators were not permitted to ask questions of the speakers.  <a href="http://www.wvgazette.com/News/201102171508?page=1&amp;build=cache" target="_blank"> Story here.</a></p>
