		<description>There is one very important thing not being considered, and that is the tests used by the WV Water Research Institute are THE WRONG TESTS. To my knowledge, unless the WV-WRI has changed protocol, they are still using the 900 series, which is only good on treated drinking water. 

Any water high in TDS (total dissolved solids) or TSS (total suspended solids) must be tested with the 21-day hold test. This is the only way to detect all of the alpha and beta particles in the water. This is because, as the article above points out, alpha and beta particles can be blocked from detection by things in the water. That means that if Ziemkiewicz is unconcerned about the alpha particles, maybe that&#039;s because he doesn&#039;t have accurate info as to how much there really IS in that water.

Several groups and individuals filed a notice of intent to sue on August 26, 2015 including the Center for Health, Environment &amp; Justice, Environmental Integrity Project, Natural Resources Defense Council, Earthworks, Responsible Drilling Alliance, San Juan Citizens Alliance, and West Virginia Surface Owners Rights Organization. 

We are calling on EPA to comply with its long-overdue obligations to update waste disposal rules that should have been revised more than a quarter century ago.

The oil and gas industry is growing by leaps and bounds.  EPA must do its job and update and enforce these vital regulations. Our water and air are threatened by toxic waste from the improper storage of fracking wastes while corporate polluters are allowed to run wild. Homes, small businesses, and low income and indigenous communities are being laid to waste by an industry that is virtually unregulated.
